Suisse - Développement de médicaments pédiatriques dès le 1er janvier 2019

Afin d’encourager le développement de médicaments pédiatriques, il sera possible, à l’avenir, de prolonger la durée de protection de médicaments spécialement conçus pour cette tranche d’âge. Le 21 septembre 2018, le Conseil fédéral a fixé la date de l’entrée en vigueur des modifications requises à cet effet dans la loi sur les brevets et l'ordonnance s’y rapportant : la nouvelle réglementation s’appliquera dès le 1er janvier 2019.
 En vue de promouvoir le développement de médicaments spécialement conçus pour cette tranche d’âge, la loi sur les brevets prévoit de nouvelles incitations : les fabricants de médicaments qui réalisent des études pédiatriques sur des médicaments et démontrent les possibilités de leur utilisation chez les enfants obtiennent une prolongation de six mois de la protection de leurs brevets. Cette "prolongation pédiatrique", comme on l'appelle, a pour but de compenser, du moins en partie, les coûts supplémentaires de recherche et développement.

OREO vs TWINS - cookies with reputation


In case C‑487/07 the European Court of Justice clarified the European trademarks "with reputation" enjoy a broader level of protection under EU trademark law. Trademark owners that are able to show that their European Trademarks are known to a large portion of the public can not only act against younger identical and confusingly similar trademarks that are used for similar goods or services, but also against younger similar trademarks for goods/services that are not similar. This higher level of protection is only applicable if the use of the allegedly infringing trademark is without due cause and would take unfair advantage of, or be detrimental to, the distinctive character or reputation of the earlier EUTM. Therefore, OREO had gained reputation over the years, consumers will likely consider TWINS to be a possible replacement of the OREO cookies on the grounds of similar quality characteristics. Brand Finance 2015 - Lego is ranked the world’s most powerful brand

Brand Finance’s analysis this year has found that Lego is now the world’s most powerful brand, scoring highly on its Brand Strength Index for familiarity, loyalty, promotion, staff satisfaction and corporate reputation. Other brands to do well on the Brand Finance Brand Strength Index include PWC, Red Bull, McKinsey, Unilever, L’Oréal, Burberry and Rolex. Twitter is the fastest growing brand, according to this year’s research.

Italia - Durata di protezione del diritto d'autore - DECRETO LEGISLATIVO 21 febbraio 2014, n. 22



E’ stato pubblicato in G.U. n. 58 del 11 marzo 2014 – il Decreto Legislativo 21 febbraio 2014 n. 22 attuativo della direttiva 2011/77/UE che modifica la direttiva 2006/116/CE concernente la durata di protezione del diritto d'autore e di alcuni diritti connessi.
La novità più importante del predetto decreto legislativo riguarda la modifica all’art. 75 delle legge 22 aprile 1941, n. 633 e la conseguente estensione della durata della protezione del diritto d’autore.
La nuova formulazione dell’art. 75 prevede espressamente: “La durata dei diritti previsti nel presente capo è di cinquanta anni dalla fissazione. Tuttavia se durante tale periodo il fonogramma è lecitamente pubblicato, i diritti scadono settanta anni dopo la data della prima pubblicazione lecita. Se nel periodo di tempo indicato nel primo comma non sono effettuate pubblicazioni lecite e se il fonogramma è lecitamente comunicato al pubblico durante detto periodo, i diritti scadono settanta anni dopo la data di tale prima comunicazione al pubblico”.

Tunisia Joins the International Trademark System


Tunisia's Minister of Industry Mehdi Jomâa and WIPO Director General Francis Gurry hailed on October 21st, 2013 the entry into force of the Madrid Protocol in Tunisia, while reviewing bilateral cooperation and discussing WIPO's future technical assistance to Tunisia. Under the WIPO-administered Madrid system, a trademark owner may protect a mark in up to 90 countries plus the European Union with its Community Trade Mark (CTM) by filing one application, in one language (English, French or Spanish), with one set of fees, in one currency (Swiss Francs).  Applicants wishing to use the Madrid system must apply for trademark protection in a relevant national or regional trademark office before seeking international protection.  An international registration under the Madrid system produces the same effects as an application for registration of the mark in each of the contracting parties designated by the applicant

China amends trademark law – entering into force on 1st May 2014


On 30 August, the Standing Committee of the National People’s Congress, adopted amendments to Chinese Trademark Law. It is the third time that the country’s trademark legislation has been revised since the original Trademark Law of the Republic of China was introduced on 1 March 1983. The latest amendments, containing various revisions, will enter into force on 1 May 2014. Key changes relate to speeding up the application procedure; simplifying the opposition system; strengthening trademark rights; protecting well-known trademarks; regulating the activities of trademark agencies and other procedural revisions.

Nuove norme UE anti-contraffazione in vigore dal 1 gennaio 2014


Entrerà in vigore il 1 gennaio 2014, la versione aggiornata delle norme europee relative all’azione doganale nei confronti di merci sospettate di violare diritti di proprietà intellettuale. L’attuale Regolamento CE n. 1383/2003 sarà quindi sostituito dal nuovo Regolamento (UE) n. 608/2013 del 12 giugno 2013 (http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2013:181:0015:0034:IT:PDF) relativo alla tutela dei diritti di proprietà intellettuale da parte delle autorità doganali. Il nuovo regolamento contiene diverse novità, di cui le più significative sono una procedura rapida per la distruzione dei falsi inviati per posta; la possibilità di tutelare in dogana anche le denominazioni commerciali ed il divieto di ingresso ai dispositivi che eludono misure tecnologiche. Il nuovo regolamento non contiene invece novità sulla questione delle cosiddette merci in transito, cioè provenienti da, e destinate a, pesi extra-UE ma che transitano per uno o più paesi UE. Nuove norme sulle merci in transito sospettate di violare diritti di proprietà intellettuale saranno probabilmente contenute nella nuova versione del Regolamento sul marchio comunitario attualmente al vaglio del Parlamento Europeo.

Copyright - Illegal music file sharing decline

According to market research firm NPD’s “Annual Music Study 2012”, illegal music file sharing declined significantly in 2012. Last year the number of consumers using peer-to-peer services to download music declined 17 percent compared to the previous year. NPD cited an increased use of legal streaming music sites as being behind the drop.

UE - Accordo sul Tribunale Unico Europeo

In data 19 febbraio 2013 si è svolta a Bruxelles la cerimonia per la firma dell’Accordo sul Tribunale Unico dei Brevetti. L’accordo, al quale hanno aderito 24 paesi dell'Unione Europea prevede l’istituzione di un Tribunale Unico avente sedi a Parigi, Londra e Monaco il quale avrà competenza esclusiva per il brevetto unitario ed il brevetto europeo. Segnaliamo che l'Italia è tra i paesi firmatari, per contro, non hanno aderito all'accordo la Spagna e la Polonia. Conclusa la cerimonia delle firme, si apre ora la fase delle ratifiche nazionali dell’accordo. L’entrata in vigore sia dell’Accordo sul Tribunale Unico dei Brevetti, sia dei regolamenti sul brevetto unitario sono condizionati alla ratifica dell’accordo da parte della Germania, del Regno Unito, della Francia e di almeno altri 10 paesi.

Parlamento Europeo - dal 2014 arriva il Brevetto Unitario

L’11 dicembre 2012 il Parlamento Europeo ha adottato due regolamenti  relativi alla futura introduzione del "Brevetto Unitario”, un nuovo strumento di tutela che permetterà di ottenere protezione in 25 paesi dell’Unione Europea – cioè tutti i paesi membri UE tranne l’Italia e la Spagna – tramite un’unica procedura di deposito. Ad oggi, non è ancora certa la data in cui il brevetto unitario entrerà effettivamente in vigore: secondo una previsione molto ottimistica della Commissione Europea, le prime domande potrebbero essere presentate già nel 2014. In che modo il brevetto unitario si differenzia dal brevetto europeo già esistente? Il Brevetto Europeo prevede una domanda unica, ma la domanda non copre automativamente tutti i paesi aderenti al brevetto europeo. Inoltre, il richiedenete deve designare i paesi di interesse e, una volta concesso, il brevetto deve essere convalidato in ciascun paese tramite procedure che richiedono la traduzione del brevetto stesso nelle lingue nazionali. Per contro, il Brevetto Unitario, sarà automaticamente valido in tutti i 25 paesi aderenti e non richiederà alcuna traduzione nelle lingue nazionali.

Farmaci - Istituita la banca dati nazionale per il monitoraggio della sperimentazione

E' istituita una banca dati nazionale relativa al monitoraggio della sicurezza dei medicinali in sperimentazione clinica al fine di: rendere disponibili in formato elettronico all'AIFA e ai comitati etici le reazioni avverse gravi e inattese (SUSARs) nazionali e i Development Safety Update Reports (DSURs) delle sperimentazioni cliniche con almeno un centro in Italia; effettuare analisi descrittive e predisporre report periodici. I contenuti, le modalita' di utilizzo della banca dati e le misure transitorie di implementazione saranno comunicati agli operatori tramite il Portale dell'AIFA (Agenzia Italiana del Farmaco, Determinazione 20/9/2012, G.U. n. 228 del 29/9/2012 ).

WIPO - International Patent Filings - A new record in 2011


Despite difficult economic conditions, international patent filings under the WIPO-administered Patent Cooperation Treaty (PCT) set a new record in 2011 with 181,900 applications – a growth of 10.7% on 2010 and the fastest growth since 2005.

The sign "VIAGUARA" cannot be registered as a Community trade mark for drinks

The sign "VIAGUARA" cannot be registered as a Community trade mark for drinks. Use of that sign is likely to take unfair advantage of the distinctive character or repute of the trade mark VIAGRA. In a recent decision The General Court of the European Union (Judgment in Case T-332/10 ) Viaguara S.A. v OHIM concludes that Viaguara S.A, by using a mark similar to the earlier mark, is attempting to ride on the coat-tails of that mark in order to benefit from its power of attraction, its reputation and its prestige, and to exploit, without paying any financial compensation, the marketing effort expended by the proprietor of that mark in order to create and maintain its image, to promote its own products. Therefore, the advantage resulting from such use must be considered to be an advantage that has been unfairly taken of the distinctive character or the repute of the mark Viagra.

Sviluppo Economico - bandi per favorire la registrazione di nuovi brevetti e modelli industriali


Il ministero dello sviluppo economico, nell’ambito del Pacchetto Innovazione, ha promosso due bandi di finanziamento a favore di micro, piccole e medie imprese al fine di incentivare il ricorso alla registrazione di nuovi brevetti, disegni e modelli industriali e favorirne la loro valorizzazione economica. Le due iniziative dispongono di un finanziamento complessivo di oltre 45 milioni di euro: Le domande a partire dal prossimo 2 novembre fino ad esaurimento dei fondi.

Smell Trademark - CH - recipe for candied almonds

Recently in Switzerland a trade mark application was filed for the "smell of candied almonds" for jewellery and watches in class 14. The Swiss IPO and the Federl Administrative Court both refused the application on the ground that a description of a smell is insufficiently clear and defined because temperatures in the pan could vary, mineral traces in the water might change the smell, and the skill of the cook was a subjective element that could not be standardized.
This due to thre fact that the applicant amended the application and included a detailed recipe, specifying the type, quality and quantity of each ingredient and giving step-by-step instructions as to how to prepare candied almonds.
According to IPO and Federal Administrative ruling there is no known method for describing a smell graphically despite the presence of a well-specified cooking recipe with all ingredients (almonds, water, sugar, vanilla extract, cinnamon) and a well-known process (caramelization).

UE – ECJ rules on geographical indication ‘Cognac’

With a recent Judgment in joined Causes C-4/10 and C-27/10 the ECJ stated that “a trade mark containing the geographical indication ‘Cognac’ cannot be registered to designate a spirit drink not covered by that indication”. The commercial use of such a mark would adversely affect the protected indication
Under the regulation on the protection of geographical indications for spirit drinks (Regulation No 110/2008 of the European Parliament and of the Council of 15 January 2008), it is possible to register as a geographical indication the name of a country, region or locality from which a spirit drink originates, where a given quality, reputation or other characteristic of that drink is essentially attributable to its geographical origin. A registration of that kind is made upon application by the Member State of origin of the drink. The application must be accompanied by a technical file listing the specifications which the drink must meet if it is to be able to be designated by the protected geographical indication. Furthermore, the regulation prohibits the registration of trade marks which may adversely affect a protected geographical indication and states that, as a general rule, where such a mark has already been registered, it must be invalidated. The regulation mentions ‘Cognac’ as a geographical indication identifying wine spirits originating from France.
Gust. Ranin Oy, a Finnish company, applied in Finland for the registration, for spirit drinks, of two figurative marks in the form of a bottle label bearing descriptions of the spirit drinks containing the term ‘Cognac’ and its Finnish translation, ‘konjakki’. Although the Finnish authorities have accepted the application for registration, the Bureau national interprofessionel du Cognac – a French organisation of cognac producers – contests the legality of that registration before the Finnish courts. The Korkein hallinto-oikeus (Supreme Administrative Court, Finland) asks the Court of Justice whether it is permissible under the regulation to register national trade marks containing the term ‘Cognac’ for products which, in terms of manufacturing method and alcohol content, do not meet the requirements set for the use of the geographical indication ‘Cognac’.
In its judgment, the Court states, first of all, that although the contested marks were registered on 31 January 2003 – that is to say, before the regulation entered into force – that regulation is applicable in the present case. In that connection, the Court observes that the retrospective application of the regulation does not undermine the principle of legal certainty or the principle of the protection of legitimate expectations. The obligation on Member States to prevent the use of a geographical indication identifying spirits for alcoholic beverages which do not originate from the place designated by that indication has existed in EU law since 1 January 1996. Next, the Court observes that the two Finnish trade marks, registered on 31 January 2003, cannot benefit from the derogation provided for under the regulation, in accordance with which the use of a mark which was acquired before the date of protection of the geographical indication in the country of origin (or before 1 January 1996) is permitted, even if it adversely affects the geographical indication concerned. In that regard, the Court points out that, independently of the protection it enjoys under French law, the term ‘Cognac’ has been protected as a geographical indication under EU law since 15 June 1989. The Court also finds that the use of a mark containing the term ‘Cognac’ for products which are not covered by that indication constitutes a direct commercial use of the protected indication. Such a use is prohibited by the regulation in so far as it concerns comparable products. The Court finds that this may be the position in the case of spirit drinks. Likewise, the Court finds that the fact that the two Finnish marks incorporate part of the name ‘Cognac’ means that, when the consumer is confronted with the name of the marks on the bottles of spirit drinks not covered by the protected indication, the image triggered in his mind is that of the product whose designation is protected. The Court points out that such ‘evocation’ is also prohibited under the regulation. In those circumstances, the Court holds that the Finnish authorities must invalidate the registration of the contested marks.

UE - ECJ rules in L'Oreal vs eBay case

In a long-awaited ruling, the Court of Justice of the European Union clarified that an online market operator has played an active role by optimising or promotion infringing items for sale, it cannot rely on the exemption from liability which the E-Commerce Directive provides. The ECJ added, among other things, that EU Member States were obliged under the IP Enforcement Directive to ensure that their courts take measures that help to end trade mark infringements by users of online marketplaces, as well as preventing further infringements. Injunctive relief must be effective, proportionate, and dissuasive and must not create barriers to legitimate trade

Global Innovation Index 2011 - Switzerland ranks first among 125 economies on innovation levels

Following "The Global Innovation Index (GII)" 2011 edition, Switzerland topped this year's GII ranking, gaining three spots from its position in last year’s GII. Sweden and Singapore follow in the 2nd and 3rd positions, respectively. Joining INSEAD as Knowledge Partners for the report were Alcatel-Lucent, Booz & Company, the Confederation of Indian Industry (CII), and the World Intellectual Property Organization (WIPO), a specialized agency of the United Nations. This year’s rankings show that innovation has become a global phenomenon with six European economies (including Finland 5th, Denmark 6th, the Netherlands 9th and the United Kingdom 10th), two Asian (including Hong Kong, SAR, China 4th) and two North American economies (the United States 7th and Canada 8th) in the top 10.
